HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

HD Esthetique is committed to protecting the privacy of your protected health information ("PHI"), which is information that identifies you and relates to your health, care, or payment for care. We are required by law to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.

How we may use and disclose your health information

  • For treatment. We may use and disclose your PHI to provide, coordinate, and manage your care, including with physicians, nurses, technicians, and other personnel involved in your treatment, and with other providers we consult or refer you to.
  • For payment. We may use and disclose your PHI to obtain payment for the care we provide, for example to verify coverage, process claims, or arrange financing.
  • For health care operations. We may use and disclose your PHI for operations such as quality assessment, staff review, training, licensing, care coordination, and general administration.
  • Appointment reminders and options. We may contact you to remind you of appointments or to tell you about treatment options, health-related benefits, or services that may interest you.
  • Individuals involved in your care. With your agreement, we may share relevant PHI with a family member, friend, or other person you identify as involved in your care or payment.

Uses and disclosures that require your written authorization

Most uses and disclosures of PHI for marketing, any disclosure that is a sale of PHI, and disclosure of psychotherapy notes (if any) require your written authorization. Other uses and disclosures not described in this Notice will be made only with your written authorization, which you may revoke in writing at any time, except to the extent we have already acted in reliance on it.

Photographs and before/after images

We will not use your photographs or before-and-after images for marketing, advertising, social media, or the website without your separate written authorization, which you may revoke as described above.

Other permitted or required uses and disclosures

Subject to conditions in the law, we may use or disclose PHI: as required by law; for public health activities; for reports of abuse, neglect, or domestic violence; for health oversight activities; in judicial and administrative proceedings; for law enforcement purposes; to coroners, medical examiners, and funeral directors; for organ and tissue donation; for certain research; to avert a serious threat to health or safety; for specialized government functions such as military and national security; for workers' compensation; and for correctional institutions.

Your rights regarding your health information

To exercise any of these rights, contact us using the information below.

  • Access. You may inspect and obtain a copy of your PHI in a designated record set, in the form you request when readily producible.
  • Amendment. You may request that we amend PHI you believe is incorrect or incomplete.
  • Accounting of disclosures. You may request a list of certain disclosures we have made.
  • Restrictions. You may request restrictions on certain uses and disclosures. We are not required to agree, except that we must agree to a request to restrict disclosure to a health plan for payment or operations for an item or service you paid for in full out of pocket.
  • Confidential communications. You may request that we communicate with you by alternative means or at an alternative location.
  • Paper copy. You may obtain a paper copy of this Notice even if you agreed to receive it electronically.
  • Breach notification. You have the right to be notified in the event of a breach of unsecured PHI.

Our duties

We are required to maintain the privacy of your PHI, provide this Notice, follow the terms of the Notice currently in effect, and notify affected individuals following a breach of unsecured PHI. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any we receive in the future. The current Notice will be posted on our website and available at our office.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us using the contact information below, or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
